Changes to Orders

 

Commissions are to be completed as per details in the submitted quote form. Submittal of the quote form initiates the term. We agree to provide the services to you as they are described on our website. Any changes to the original submission may result in a fee being added to your quote. We are not obligated to modify your services to reflect these changes. If a fee is incurred, the commissioner will be required to resubmit a new quote form resulting in a new payment agreement. We may make changes to the services described on our website if (1) a supplier makes components unavailable, (2) if the requested change is not cost effective, (3) if a beta period ends or (4) at any time effective on the end of the Term of a particular service.

 

 

Payment and Shipping

 

Deposits MUST be made within three months of the given quote. Quotes are only valid for three months; quotes over three months old are considered invalid and will require a new quote form to be submitted. We provide three ways for you to purchase our services: PayPal, Personal Check or Money Order. If you choose to purchase through PayPal, you are responsible for a convenience fee of 5% at the time of each payment. Shipping is not included in the quoted price as it varies in weight and location. Buyer/commissioner is responsible for paying all shipping cost at the time of costume completion. Insurance is mandatory for shipping. We are not responsible for anything lost or destroyed in the mail system. All payments made are non-refundable.

 

 

Right to Refuse

 

We may decline to accept a request for service if we determine that we require the facilities for other needs. Should operational needs require us to restrict to allocate services among customers because of a shortage of facilities or cause beyond our control, we may do so without breaching this Terms of Service.

 

 

Warranty and Coverage

 

A 1-Year Warranty is included with the purchase of a Head, Body, Partial suit, or Full suit. Commissioner/buyer is responsible for shipping charges. If you resell or transfer ownership of the product, this will void any warranty associated with the product. FruitSuit Creations cannot be held liable for any product that has been transferred or resold. Unless expressly stated during the ordering process, we have no obligation to provide support to End Users. If the warranty is voided for any reason, you are solely responsible for any repair services. If we determine that damage occurred due to neglect, misuse, abuse, or the product was not used for its intended purpose, the warranty is void. Examples of such include but are not limited to: reckless activity resulting in excessive wear and tear that compromises the integrity of the structure, mature and/or adult activity, alterations performed by anyone other than FruitSuit Creations (unless authorized), improper hygiene, improper product maintenance and improper product storage. We are not responsible for any vandalism, terrorism, or "acts of God". Examples of such include but are not limited to: damage caused by a third party, intentional damage (self or third party), car accidents (not fully covered, per case basis), fire, tornadoes, floods, hurricanes, etc. We are not held responsible for damages incurred during shipping. We reserve the right to determine if damages deserve repair. If so, commissioner/buyer is held responsible for shipping charges.

 

 

Maintaining Up-to-Date Information

 

You must keep us up-to-date on all necessary information which includes: legal name changes, address changes, updated contact information (phone number, email, social media), etc. We will rely on the information provided to us. It is your obligation to keep this information up-to-date. We are not liable if communications are delayed, or not delivered, because of your failure to keep this information up-to-date. Please ensure that the email address you provide to us is configured in a way so that information from us is not rejected or marked as SPAM.

 

 

Final Agreements

 

The Commissioner/buyer is responsible for on time payment by the dates agreed upon in the payment schedule, or they forfeit their place in queue. Work will not begin until full payment is received. Failure to make on-time payments can result in cancellation of your commissions/items completion. Deposits are NON-REFUNDABLE. Service cancellation requested by the commissioner/buyer does not guarantee a refund. If a cancellation is requested, we reserve the right to review it and determine if any refund will be issued. 

 

 

BY PAYING THE REQUIRED DEPOSIT, YOU CONSENT TO BE BOUND BY THE TERMS OF THIS TOS. THE EFFECTIVE DATE OF THIS TOS IS THE DATE WE ISSUED A QUOTE FOR SERVICE.

 

 

Allergen Warning:

We have, and work around, cats, dogs, birds, and reptiles. If you have severe allergies to them, do not commission us.
